Use Cases for the MyData Scheme
MyData Initiative, which allows people to have control over their data to request the transfer between different platforms to improve their lives, will be launched to the fullest. Right to Data Portability, a.k.a. the MyData Scheme, was included by the amendment to the Personal Information Protection Act (PIPA) in March 2023, and it will take effect from March 13, 2025. Before the amendment, the MyData scheme was implemented in financial and public sectors under each law with a limited scope. Still, the amendment provides an opportunity for the scheme to cover more sectors. The Personal Information Protection Commission (PIPC) has the capacity to operate the MyData scheme, saying healthcare and communications sectors are prioritized because these sectors have higher spillover effects compared to other sectors in an early stage of the implementation of this initiative. The scheme will cover the energy sector from June 2026. The PIPC has selected 10 key industries that are highly associated with people’s daily lives: healthcare, communications, energy, transportation, education, employment, real estate, logistics, and leisure sectors. It will explore ways to accommodate more sectors step by step. MyData scheme allows data subjects to exercise the right to data portability, requesting the transfer of personal data to them or transfer of personal data to third-party entities, including MyData service providers, for the purposes of using services they want. Data subjects found it difficult to exercise their rights in utilizing and managing their personal information after giving consent to businesses or agencies to use services they provided. Businesses and agencies faced challenges where data silos prevented personal information from being actively utilized, leading to failures in revitalizing the data ecosystem. However, this scheme can empower users to manage and reuse their data across various digital services and platforms. It allows data subjects to have control over their personal information, enabling them to request the transmission of personal information between different platforms to use services they want. Sectoral data convergence will be activated, brining innovation to economic fundamentals for data as well. To support data subjects to exercise their right to data portability, the PIPC plans to open a “Pan-Government MyData Support Platform (tentative name)” in the first half of this year, where users can have access to the pool of businesses where a data subject can request to receive the personal data concerning him or her, and the status of MyData service providers. Chiarperson Haksoo Ko of the PIPC said, “MyData scheme implemented in more sectors enable people to become a true owner of their data,” adding that “The PIPC will gather feedback from various industries to gradually accommodate more sectors that can deliver tangible results and have cascading effects.” In the meantime, the PIPC will release a guidance material regarding the MyData Scheme on the website and plans to hold a briefing session for people and relevant businesses on Tuesday, March 18, 2025. * A PDF file, formatted for better readability, is attached.
