Council of Europe Convention 108 (개인정보보호 국제협약)

  • CoE 108호 협약(Council of Europe Convention 108)은 1950년 발표된 유럽인권조약에 근거해 유럽평의회가 1981년에 채택한 개인정보보호 관련 국제협약입니다. 모든 개인의 기본적 자유와 권리의 보장을 목적으로 합니다.
  • CoE 108호 협약은 세계 최초의 개인정보보호 관련 국제협약으로, OECD 프라이버시 가이드라인의 원칙을 대부분 반영하면서 참여국의 협력 및 의무 사항을 규정하고 있습니다. 협약 자체의 집행력은 없지만 협약에 가입한 국가는 협약의 개인정보보호 규정을 국내법에 반영하는 것이 의무화되어 있습니다.
  • CoE는 2018년 환경 및 기술 발전에 따라 민감정보, 개인정보 국외이전 등의 내용이 반영되어 개정(modernization)된 223호 협약을 채택하였습니다. 108호 협약은 55개 국가가 서명·비준하였고, 223호 협약은 34개국이 서명하고 8개국이 비준하였습니다.(2020년 기준)
  • 한국은 2012년부터 CoE 108 협약 회의에 옵서버(Observer)로 참여하고 있습니다.
